Real Estate Counseling

 

Counseling work has included problem-solving solutions and answers to particular questions involving commercial real estate.  Counseling assignments include current and retrospective opinions of market value, trends within defined boundaries, historical buildings, Tax Increment Financing District, access-related issues and the impact of zoning changes on property values.  The following represents a sample of counseling assignments.

 

Southern Methodist University.  Mr. McRoberts was engaged by SMU to provide an opinion of the most probable price being paid for residential land within a geographic boundary defined by the client and within a stated transaction period.  The conclusions reached was used by SMU and the City of University Park in negotiating a land acquisition/disposition price for land desired by SMU for the George W. Bush Presidential Center – abandonment of streets, alleys, and utility right-of-way(s).

 

Dallas Baptist University. This counseling matter involved a portion of the school campus overlooking the eastern shore of Mountain Creek Lake, to be acquired for the Dallas - Fort Worth National Cemetery.  A written report and oral report was provided to the school.

 

Preservation Dallas.  This counseling matter pertained to an “Application for Certificate of Demolition or Removal” of Dallas High School.  Additionally, the assignment involved various other related documents as provided by the property owner and their legal counsel to the Economic Review Panel for Dallas’ Landmark Commission.  Expert testimony was before the panel on behalf of Preservation Dallas regarding findings and conclusions.

 

Department of Justice Canada and Revenue Canada. Services included the evaluation of a bulk-sale agreement of residential condominium units in The Claridge.  The research involved an eleven-year retrospective analysis of the Dallas condominium market.  Development of an extensive transaction database enabled various variable sorts for statistical analysis so to examine and opine as to the validity of an investment forecast by a Canadian promoter.  Professional testimony was before the Federal Tax Court in Toronto, Ontario.

 

Scharnhorst Ast & Kennard, PC. Determine the value enhancement for the 30-story SandRidge Tower (Oklahoma City) with the proposed installation of the RENOVATE Platinum Plus II window system by Berkowitz.  The assignment was in a contractor construction dispute over HVAC issues, and a window system offered as a solution.  Testimony was before an arbitration panel in Oklahoma City.  The analysis calculated the energy savings based on a case study analysis coupled with the monetized savings testing the cost/benefit of the Platinum Plus II window system versus the existing (1971) single-pane windows.

 

Jackson Walker, LLP. Prepared a benefits study for the redevelopment of the Mercantile Complex in downtown Dallas.  Forest City Enterprises and their legal representation (Jackson Walker) were seeking over $70 million for the development/redevelopment of the building complex.  Testimony was provided to the Downtown Connection TIF and Dallas City Hall.

 

Strasburger & Price, LLP. This consultation matter involved a dispute over the value of a development partner’s interest in a property partnership.  The assignment resulted in the interpretation of a real estate development employment contract between employer and employee.

 

Kemper Financial Services.  Conducted a market study of general land values for specific zoning categories in Las Colinas.  Also, assistance was provided of a sell-out forecast of Kemper’s in-house cash flow model.  The report was to be used internally by the client for their evaluation of Dallas County Utility Reclamation District (DCURD) bonds.
